The timing of a U.S. Senate vote on the Clarity bill, a crypto market structure law, has slipped to Aug. 6 local time. Opposition from investigative agencies has eased significantly, but a conflict-of-interest fight over President Donald Trump’s memecoin profits remains the biggest variable.
Foreign media, including blockchain outlets CoinPost and CryptoSlate, reported that even after a signing deadline that had been set for July 4 passed, senators had not reached agreement on key issues. Senators are in the second week of a two-week summer recess, and if talks are wrapped up after Congress returns on the 13th, the possibility has been raised that a floor vote could take place in the week that includes July 20.
At the centre of the dispute is Section 604, the so-called Blockchain Regulatory Clarity Act, or BRCA. It is a safe-harbour provision that would exempt software developers or infrastructure providers who do not directly control user funds from being treated as money transmitters under the Bank Secrecy Act. Liability would still apply if they fall outside the scope or move funds to launder criminal proceeds.
There was a clear change in stance from the law enforcement camp. The National Organization of Black Law Enforcement Executives, or NOBLE, officially supported the entire bill, including the BRCA, becoming the first major law enforcement group to back legislation that includes the BRCA. NOBLE said the provision does not change existing criminal authority and does not affect laws related to money laundering or unlicensed money transmitters.
The Major County Sheriffs of America, or MCSA, also shifted from opposing the bill to a neutral stance. MCSA said there is room to further strengthen the bill, prompting concern in parts of the industry that the BRCA could be amended or weakened in the process.
Differences over ethics provisions have not been resolved. Trump’s financial disclosure documents listed more than $1 billion in crypto-related income last year, including more than $600 million from the TRUMP memecoin. Democratic Senator Kirsten Gillibrand (커스틴 길리브랜드) again called for ethics rules that would ban the president, lawmakers and their spouses from issuing or sponsoring digital assets.
BitGo CEO Mike Belshe (마이크 벨시) countered that ethics rules should apply equally across all asset classes. Senators Ruben Gallego (루벤 가예고) and Angela Alsobrooks (앤절라 알소브룩스) also reacted strongly to Trump’s financial disclosure, saying they could maintain their support only if an effective ethics agreement is reached before a floor vote.
If Republicans accept a limited ethics amendment, Democrats could have room to accept the BRCA safe harbour. If the standoff over ethics provisions drags on, the Clarity bill could find it harder to secure floor time after the recess.
The dispute shows that the question of how far to recognise the scope of crypto developer liability and how to reflect conflict-of-interest rules for public officials in legislation is colliding within a single bill.
